Terms & Conditions
1. All orders require a 50% deposit upon reserving the order. 25% is non-refundable. This amount will apply to the balance of the order when you receive your rental items. Payments are due in full before equipment is delivered and before a Will Call is picked up. A credit card number must be provided as an additional security deposit. Any items returned after the return date stated on the invoice will continue to accrue a daily rental fee until returned.
2. There will be a 25% restocking fee if rental items are cancelled 3 days prior to delivery or Will Call. A 50% restocking fee if items are cancelled 3 days prior to Will Call or if rental items have already been loaded on truck for delivery. Rentals are non-refundable if cancelled within 24 hours or less of delivery or will call.
3. ALL dishes and glassware items need to be rinsed and scraped, and put back into crates. If not properly rinsed, there will be a $0.15 charge for every item not rinsed.
4. Rental items will be charged while out on rental whether used or not. Items rented shall be and remain as exclusive property of OCPR. The Customer shall have the rights to use the rental items with the Terms of this rental agreement. Customer agrees not to remove any identifiable markings such as stickers identifying its ownership. All rental items shall not be removed from place of delivery or installation without permission from OCPR.
5. Customer will take precaution in all items rented and protect property from damage. Customer will be responsible for all equipment damaged due to rain, sprinklers, or other circumstances. Customer agrees to hold OCPR free from any and all liabilities including claims, judgments, attorney’s fees and costs but not limited to injuries or death and damage to property. Customer is aware of possible risk of injury or damage that may occur from use or operation of rental items. The Customer agrees to Waive, release and discharge any claims which may otherwise be entitled to assert.
6. If Customer notices any rental items to be unsafe, the Customer agrees to discontinue use and notify OCPR to repair or replace with similar item or items if available. OCPR is not responsible for incidental damages caused by possible delays and Customer waives any right or entitlement thereto.
7. OCPR is not the manufacturer of the rental items and does not warranty against defects in workmanship. The Customer waives all such warranties. There is no warranty that items rented are suited for Customer’s intended use. Customer acknowledges they have had the opportunity to inspect the rental items and finds the items suitable for Customer’s needs. It is the Customer’s responsibility to inspect the rental items and notify OCPR of any defects prior to use.
8. Customer shall defend, indemnify and hold harmless OCPR, its employees, agents, and subsidiaries, from and against all claims, demands, including claims of liability to third parties, losses, liabilities, damages to property or otherwise, and expenses of every character resulting from the actions, negligent or otherwise of Customer, Customer’s Employees, agents or any subcontractor of Customer.
9. Return of Rental items as specified date on invoice, the Customer agrees to return all rental items to OCPR’s premises during normal business hours in the same condition as delivered to Customer, subject only to reasonable wear and tear. If Customer fails to return rental items within normal business hours, the Customer shall be liable for any loss and all damages that may occur. If OCPR delivered or picked up rental items from Customer, the Customer shall be responsible for any damage or loss of rental items from time of delivery to the Customer until picked up by OCPR. OCPR shall have the right at any time to enter the premises where the rental items are located for observing its use or inspecting it or removing from the premises.
10. The Customer may not sublease or loan the rental items without OCPR’s written permission. The Customer’s right of possession shall terminate on the expiration date on invoice and retention of possession of rental items constitutes material breach of Customer’s obligations. Any proposed extension must be agreed upon by OCPR in writing and at OCPR’s discretion.
11. Customer agrees not to use or allow anyone to use the rental items for any illegal purpose or in any illegal or unsafe manner. Customer agrees at Customer’s sole cost and expense to comply with all municipal, county, state and federal laws, ordinances and regulations which may apply to the use of rental items during the rental period. Customer is responsible for obtaining all permits/licenses from appropriate government agencies. Customer further agrees to pay all licenses, fines, fees, permits or taxes arising from Customer’s use of rental items, including any subsequently determined to be due. OCPR may act as the agent to obtain required permits at Customer’s request. Should these agencies require additional rental items, the Customer agrees to be responsible for any additional expense. If for any reason the permits or licenses are denied, the Customer is still obligated to be responsible financially. The Customer agrees to pay for rental items at the replacement cost when rented for all types of theft or mysterious disappearance. OCPR may, at its discretion, report the rental property stolen if held five days beyond the due date of expected return date.
12. Delivery is made at the closest point a delivery truck can park. Extra charges to Customer will result when extra delivery time is required such as upstairs or elevators. Unless prior arrangements have been made and Customer agrees paying setup fee, OCPR will not set up or take down tables and chairs. If no arrangements were made and Customer desires this service upon delivery, our driver must call for authorization and the Customer will be charged accordingly. Upon pick up where no prior arrangements have been made and rental items are not knocked down and assembled in one area, the equipment may be left until the next day when crew can be scheduled. This will result an additional one day rental fee. A knock down fee will result if rental items are still up.
13. Customer agrees to pay for any damage to rental items when not in possession of OCPR except for reasonable wear and tear. Customer will pay reasonable cleaning fees for all rental items returned dirty. Rental items damaged beyond repair will be paid for by Customer at its replacement cost when rented. The cost of repairs will be borne by the Customer whether performed by OCPR or by others at OCPR’s option.
14. Return all Linens dry and free of waste. Table Linens are inspected prior to pick up and upon return. DO NOT place any wet linens in any plastic bag as mildew may occur. Customer will be charged the replacement cost of the linen if there is obvious damage such as mildew, excessive stains, burns or tears.
15. Customer assumes all weather related risks when involved in holding an outdoor tented event. OCPR takes no responsibility for any damages to persons or property which may occur as a result of extreme weather. OCPR will endeavor to minimize risk however, should tenting become unstable due to high wind, rain, flooding, Customer will still be liable for payment in full of all charges. In the event of extreme weather conditions, tents should be evacuated immediately and not utilized as shelter. All tents are not guaranteed to be waterproof and are considered to be temporary shade structures.
16. Customer agrees to have site where rental items are to be erected are free and clear of obstacles, natural and manmade, prior to the arrival of OCPR’s crew. The Customer further agrees to have all tents cleared for removal prior to arrival. If Customer fails to do so, Customer shall pay all costs involved for any delay, additional rental and all costs involving collection and legal expenses.
17. Customer is aware stakes will be driven into the ground to install tents. OCPR shall not have liability for any damage resulting to property, underground systems such as water, sewer and gas. Customer assumes all responsibility for damage to all Underground Facilities. Customer agrees to furnish OCPR access to and right to use Customer’s electrical and power lines if needed. Customer agrees not to do any type of cooking under a reasonable distance from tent. Customer assumes all costs and takes full responsibility for any damage and or cleaning expense to tent tops due to cooking processes near or under tent. Customer agrees to indemnify and hold harmless OCPR from any such liability.
18. In the event an attorney is retained to enforce any provision of these terms and conditions, the prevailing party in the dispute shall be entitled to recover reasonable attorney’s fees and court costs in such action or proceeding, in an amount to be determined by the court.
19. Customer shall maintain in full force and effect during this time of Agreement separate General Liability and Auto Liability Insurance policies with coverage limits for bodily injury, including death, personal injury and/or property damage that will respond as primary coverage for Customer’s liability and obligations outlined under this agreement. Customer shall maintain Property Insurance in an amount adequate to cover any losses and/or damage to rental items, up to full replacement cost. Customer shall furnish OCPR with a Certificate of Insurance evidencing the foregoing insurance requirements and naming OCPR as an additionally insured upon request.
20. Customer shall not allow any person who is not qualified, who does not understand the safety and operating instructions and who does not utilize all safety equipment required to operate rental items or use the rental items. Customer shall not allow any person to use or operate the rental items when the rental items are in need of repair or in unsafe condition. Customer agrees to visually inspect rental items while in their possession and to immediately discontinue and notify OCPR when in need of repair or maintenance.
21. Customer acknowledges OCPR has no responsibility to inspect the rental items while they are in the Customer’s possession.
By reserving these items, you hereby agree to all aforementioned Terms and Conditions Set Forth.
